Newer Jquery and Jquery Validate $.data() undefined

I have updated a clients web site with newer jquery (v1.11) and validate (v1.13).

I havean ajax call that includes a form into the page... Once this has been appended i get the

TypeError: $.data(...) is undefined

settings = $.data( element.form, "validator" ).settings;

has anyone come across this before? stumped on how to solve it.
